The relationship between a bank and its customer is known to be that of a debtor and criditor. The bank is obliged to honor all of the valid and proper orders of the customers to pay amounts from his account with the bank as long as the amount in the account allows doing so. So if you want to request stop payment on a cheque for any reason, you may do so. A customer has a right to give notice to his Bankers to request stop payment on a cheque that has been issued. Generally a written notice, signed by the drawer is sufficient to stop the payment. A stopped payment is usually requested if the cheque has been declared missing or lost. Hence Deutsche Bank also allows its customers to request stop payment on a cheque online as and when required.
In India, no express provision relating to stop payment of cheques exists. There are however, various judgments regarding this aspect. Indian Courts have covered this facet in Section 138 of Negotiable Instruments Act (hereinafter referred as Act), which is related to dishonor of cheques. The discussion relating to request stop payment on a cheque has assumed importance in view of the amendment to the Negotiable Instruments law by the amendment in 1988.
Under the present theme, the sole question which in the paper is whether a drawer having insufficient funds in his account and stops the payment can be held liable under Section 138 of the Negotiable Instruments Act?
